Terms of Service

1. Eligibility

You must be at least 16 years old to use Stelesy. Your age is self-declared and is not verified through identity documents. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate.

2. The Service

Stelesy provides language-learning exercises, progress tracking, social features, and AI-generated evaluation, explanations, and feedback. Learning results and analytics are educational aids, not a guarantee or certification of language proficiency.

3. AI-Generated Content

AI-generated content may be incomplete, inaccurate, or unsuitable for your circumstances. It is provided to support language learning and should not be treated as authoritative professional advice or formal assessment.

You must not manipulate, bypass, or misuse AI features, or use them to create harmful, unlawful, or unrelated content.

4. Accounts and User Content

You are responsible for keeping your account credentials and device secure and for activity under your account. Notify us at [email protected] if you suspect unauthorized use.

Information and material you submit to the Service ("User Content") remains yours. You grant us a worldwide, non-exclusive, royalty-free license to host, process, analyze, reproduce, and display User Content only as needed to operate, maintain, secure, and improve the Service. You must have the right to submit that content and must not submit illegal, infringing, or harmful material.

5. Social Features

If you use social features, profile details, learning activity, connections, and rankings may be visible to other users as indicated in the Service. You are responsible for what you choose to make visible and for interacting lawfully and respectfully with others.

6. Acceptable Use

You agree not to:

• Harass, abuse, threaten, deceive, or impersonate others.
• Submit illegal, infringing, harmful, or inappropriate content.
• Scrape or extract data through unauthorized automated means.
• Reverse-engineer the App or bypass access, payment, or technical protections, except where applicable law expressly permits it.
• Abuse promotions, referrals, subscriptions, or other Service benefits.
• Disrupt, overload, damage, or gain unauthorized access to the Service or related systems.
• Use the Service for fraud or any unlawful purpose.

7. Subscriptions and Purchases

Stelesy may offer optional paid subscriptions or purchases. The Apple App Store or Google Play handles billing, renewal, cancellation, and refunds under its applicable terms. RevenueCat manages subscription entitlement status for the Service.

Prices, plans, features, and availability may change, subject to notice or consent where required by law. Any trial or promotion is governed by the terms shown when it is offered.

Deleting your Stelesy account does not cancel an Apple App Store or Google Play subscription. You must cancel through the store that manages your subscription to stop future renewal charges.

8. Virtual Benefits

Virtual features, allowances, rewards, and promotional benefits have no cash value, are not transferable unless we expressly allow it, and may be changed or withdrawn subject to applicable law. Abuse may result in their removal.

9. Account Deletion and Suspension

You may delete your account in the app: Other → Account → Delete account. You may also request account deletion outside the app by emailing us at [email protected]. We monitor this mailbox for deletion requests and review and complete account deletion within 24 hours after we have enough information to identify the Stelesy account. Some anonymized or legally required data may remain as described in our Privacy Policy.

We may restrict, suspend, or terminate access when reasonably necessary in response to a material violation of these Terms, fraud, a security risk, unlawful conduct, or conduct that harms the Service or another person. Where appropriate and legally required, we will provide notice or an opportunity to remedy the issue.

10. Service Availability and Changes

The Service may change over time and may not always be uninterrupted or error-free. We may update, add, restrict, or discontinue features and may require a supported version of the App, subject to applicable law.

11. Intellectual Property

Except for User Content, the Service, its content, branding, and functionality are owned by the Operator or its licensors and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from them except as these Terms or applicable law permit.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without express or implied warranties. We do not warrant uninterrupted operation, error-free features, or accurate AI-generated content.

13. Limitation of Liability

To the maximum extent permitted by applicable law, the Operator is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, revenue, or profits, arising from use of or inability to use the Service.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable statutory consumer rights.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify the Operator against third-party claims, damages, and reasonable expenses arising directly from your material misuse of the Service or material violation of these Terms.

15. Governing Law and Consumer Rights

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles, except where applicable law requires otherwise.

If you are a consumer residing in the EU/EEA, mandatory consumer protection laws of your country of residence may also apply and will take precedence over this section to the extent required by law.

16. App Store Terms

If you downloaded Stelesy from the Apple App Store, Apple Inc. ("Apple") is a third-party beneficiary of these Terms and may enforce them. The license is non-transferable and limited to use on Apple-branded products you own or control as permitted by the App Store usage rules.

• We, not Apple, are responsible for the App, its content, maintenance, support, and claims relating to it.
• If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
• We are responsible for investigating, defending, settling, and discharging claims that the App infringes third-party intellectual property rights.
• You represent that you are not in a country subject to a U.S. government embargo or designated as supporting terrorism, and are not on a U.S. government restricted-party list.
• You must comply with applicable third-party terms when using the App.

If you downloaded Stelesy from Google Play, your use is also subject to the Google Play Terms of Service.

17. Changes and Contact

We may update these Terms and will update the "Last updated" date. For significant changes, we will make reasonable efforts to notify you through the Service or other available means. Continued use after changes take effect constitutes acceptance where permitted by law.
